The Liberal Democratic Party (LDP) officially approved a bill on Tuesday to criminalize the public desecration, removal, or defilement of the Japanese national flag [1].
This move represents a significant shift in Japanese law by establishing a specific crime for flag desecration. The legislation is being introduced as part of a coalition agreement between the LDP and the Japan Innovation Party [2].
Under the proposed law, individuals who publicly damage the flag with the intent to insult the nation could face up to two years of imprisonment or a fine of up to 200,000 yen [1]. The measure was formally cleared during a general affairs committee meeting held at the LDP headquarters in Tokyo on June 9 [1], [3].
Prime Minister Takaichi said she has a strong desire to see the creation of this new crime realized [4]. The administration argues that protecting the national symbol is a fundamental duty of the state, even as it balances the legal requirements of free expression [5].
Acting Secretary-General Hagiuda addressed the balance between civil liberties and national duty during the proceedings. "While giving sufficient consideration to freedom of expression, I believe that punishing the act of damaging the national flag, which is the symbol of our own country, for the purpose of insult is a natural duty as a state," Hagiuda said [5].
The LDP aims to pass the legislation during the current Diet session. The bill specifically targets acts of desecration performed in public, distinguishing them from private acts of disposal or damage [1].
