Spain's Consumer Rights Ministry has temporarily banned prediction-market platforms Polymarket and Kalshi for operating without required gambling licenses [1].
This move signals a tightening of regulatory oversight on digital financial instruments that blur the line between investment and gambling. By enforcing strict licensing requirements, Spain aims to prevent unregulated platforms from accessing its domestic market without government oversight.
The announcement was made on Tuesday, May 26, 2024 [1], via the official state gazette in Madrid [2]. The ministry identified two platforms that were in breach of Spanish gambling law [3].
"The platforms were operating without the required gambling licence, which is a breach of Spanish law," a spokesperson for the Consumer Rights Ministry said [1].
The government said that the block is a necessary measure to maintain the integrity of the national regulatory framework. The ministry said that the action is intended to safeguard the public from services that bypass legal mandates.
"We are taking swift action to protect consumers and ensure that all gambling-related services comply with the regulatory framework," the ministry said [3].
According to the official state gazette, the restriction will remain in place until the companies meet the legal requirements for operation in the country. The government has not specified a timeline for the review of potential license applications.
