The Tamil Nadu government has filed a Special Leave Petition to the Supreme Court challenging a Madras High Court order regarding a religious ceremony.
The legal move centers on the lighting of the Karthigai Deepam lamp on Tiruparankundram hill. The state said that permitting the ritual at this specific location could trigger significant law and order challenges, potentially destabilizing the peace in the Madurai district.
The dispute involves a site located about 50 metres [1] from a dargah. The Tamil Nadu government said that the ritual has traditionally been performed at a different location and should not be shifted to the disputed area.
By moving the case to the Supreme Court, the state seeks to overturn the Madras High Court's decision, which had previously permitted the lamp-lighting to proceed. The government's petition emphasizes the necessity of maintaining public security over the High Court's directive.
Officials have not provided a specific date for the upcoming hearing, but the petition remains a priority for the state administration as it navigates the tension between religious practice and civic stability.
“The Tamil Nadu government has filed a Special Leave Petition to the Supreme Court challenging a Madras High Court order”
This legal battle highlights the ongoing tension between judicial mandates for religious freedom and the executive branch's responsibility for public security. By challenging the High Court, the Tamil Nadu government is prioritizing the prevention of communal friction in a sensitive area where religious sites are in close proximity, suggesting that the state views the risk of civil unrest as outweighing the High Court's interpretation of the right to perform the ritual.
